These terms cover the Nighthum iPhone app, made by PXL Security LTD ("we"). By using the app you agree to them. Apple's standard Licensed Application End User License Agreement also applies.
Nighthum is a sound and diary tool for general wellness. It is not a medical device. It does not diagnose, treat, cure or prevent tinnitus or any other condition, and it does not replace advice from an audiologist, an ENT doctor or any other clinician. The pitch match in the app is your own report and is not a hearing test. If your tinnitus is new, in one ear only, or comes with hearing loss, dizziness or pain, see a clinician.
Keep every sound at a comfortably low level. You are responsible for the volume at which you listen. Stop using the app if you experience discomfort.
Pro is available as an auto-renewing yearly subscription with a seven-day free trial for eligible users, or as a one-time lifetime purchase. Payment is charged to your Apple Account. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and can be managed or cancelled in your Apple Account settings. Any unused portion of a free trial is forfeited when a purchase is made. Refunds are handled by Apple.
Diary entries and settings are yours and stay on your device. We do not receive them.
Do not reverse engineer, resell or misrepresent the app. Do not use it in any way that could harm others.
The app is provided as is, without warranty of any kind. To the fullest extent permitted by law, PXL Security LTD is not liable for any loss or damage arising from use of the app.
We may update these terms; the current version is always at this address.
